## Terms of Use & End User License Agreement (EULA)

Last updated: October 29, 2026

1. Purpose and scope

These Terms of Use and End User License Agreement (the “Terms”) govern the download, installation and use of any software application published by IntoProd, including Ensemble (the “Apps”), and of any related service. They apply to every App that links to this page. If an App displays specific additional terms, those supplement these Terms.

2. Acceptance

By downloading, installing or using an App, you accept these Terms. If you do not accept them, do not use the App. If you are a minor, you must have the permission of your parent or legal guardian.

3. Parties — acknowledgement regarding Apple

These Terms are concluded between you and IntoProd only, and not with Apple Inc. (“Apple”). IntoProd, not Apple, is solely responsible for the Apps and their content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in force at the time you accept them (the “Usage Rules”).

4. License

IntoProd grants you a personal, non-exclusive, non-transferable and revocable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.

You may not:

  • copy the App beyond what normal use requires;
  • modify, adapt or translate it;
  • decompile, disassemble or reverse engineer it, except to the extent permitted by law (notably art. L122-6-1 of the French Intellectual Property Code);
  • rent, lease, lend, sell, redistribute or sublicense it;
  • remove any proprietary notice;
  • use it for any unlawful purpose or in a way that could damage the App or its infrastructure.

All rights not expressly granted remain with IntoProd.

5. Purchases, subscriptions and refunds

Apps may be free, paid, or offer in-app purchases or subscriptions. All payments are processed by Apple through your Apple Account, at the price shown in the App Store, taxes included.

Auto-renewable subscriptions renew automatically at the end of each period unless you cancel them at least 24 hours before the end of the current period. You can manage or cancel them in your Apple Account settings. Any unused part of a free trial is forfeited when you purchase a subscription.

Refund requests are handled by Apple at reportaproblem.apple.com, under Apple’s terms. If you are a consumer in the European Union, you benefit from the right of withdrawal under the conditions set by Apple’s terms and by applicable law.

6. Updates and availability

IntoProd may update the Apps to fix issues, improve them, or add or remove features. Some updates may be needed to keep using an App. If a change has more than a minor negative impact on your access to or use of a paid App, IntoProd will inform you in advance, and you may exercise the rights that applicable consumer law gives you.

7. Maintenance and support

IntoProd is solely responsible for providing maintenance and support for the Apps, as described in these Terms or as required by applicable law. Apple has no obligation whatsoever to provide any maintenance or support services for the Apps. For support, please use the contact form at intoprod.com/legal/#contact.

8. Legal guarantees and warranty

If you are a consumer, you benefit from the legal guarantee of conformity for digital content and services (French Consumer Code, art. L224-25-12 et seq.) and, where applicable, from the guarantee against hidden defects (French Civil Code, art. 1641 et seq.). Under the guarantee of conformity, you may obtain that the App be brought into conformity free of charge or, failing that, a price reduction or the termination of the contract with a refund. Nothing in these Terms limits these rights.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are IntoProd’s sole responsibility.

Beyond the statutory guarantees, and to the extent permitted by law, the Apps are provided “as is”.

9. Liability

Nothing in these Terms excludes or limits IntoProd’s liability for death or personal injury, gross negligence, wilful misconduct, or any liability that cannot be limited by law. Toward consumers, IntoProd’s liability is governed by applicable law.

IntoProd is not liable for damage resulting from:

  • use of an App that does not comply with these Terms;
  • a force majeure event (French Civil Code, art. 1218);
  • third-party services such as your device, your network or iCloud.

We recommend that you back up your data regularly.

If you use an App for professional purposes, IntoProd’s total liability is limited to the amount you paid for the App in the 12 months preceding the claim, and IntoProd is not liable for indirect damages such as loss of business, revenue or data.

10. Product claims

IntoProd, not Apple, is responsible for addressing any claims by you or any third party relating to the App or to your possession or use of it, including:

  1. product liability claims;
  2. any claim that the App fails to conform to any applicable legal or regulatory requirement;
  3. claims arising under consumer protection, privacy or similar legislation, including in connection with the App’s use of any Apple framework.

11. Intellectual property claims

In the event of any third-party claim that the App, or your possession and use of it, infringes that third party’s intellectual property rights, IntoProd, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.

12. Legal compliance

You represent and warrant that:

  1. you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country;
  2. you are not listed on any U.S. Government list of prohibited or restricted parties;
  3. you are not subject to European Union restrictive measures that would prohibit your use of the App.

13. Third-party terms

The Apps may rely on third-party services, such as iCloud, Calendar or Reminders. When using an App, you must comply with the terms of any applicable third-party agreement, such as your Apple Account terms or your mobile data plan.

14. Third-party beneficiary

You and IntoProd acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Personal data

The way IntoProd processes personal data is described in the Privacy Policy at intoprod.com/legal/#privacy, which forms part of these Terms.

16. Term and termination

These Terms apply as long as you use an App. You may end them at any time by deleting the App and, where an App lets you create an account, by deleting that account from within the App. IntoProd may terminate your license if you seriously breach these Terms, after notice when the breach can be remedied. On termination, you must stop using and delete the App. Clauses 8 to 14 and 20 survive termination.

17. Changes to these Terms

IntoProd may amend these Terms. The current version is always published at intoprod.com/legal/#terms with its date. You will be informed in advance of any material change, in the App or on that page. If you do not accept the new Terms, you may stop using and delete the App.

18. Contact — questions and complaints

Any question, complaint or claim regarding the Apps can be sent to IntoProd, Lyon, France, through the contact form at intoprod.com/legal/#contact. Our full company details are available in our Legal Notice at intoprod.com/legal/#legal-notice.

19. Consumer mediation

In accordance with articles L612-1 et seq. of the French Consumer Code, if a dispute has not been resolved after a prior written complaint to IntoProd, you may refer it free of charge to the following consumer mediator, within one year of your complaint:

CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
www.cm2c.net

20. Governing law and jurisdiction

These Terms are governed by French law. If you are a consumer residing in another country of the European Union, you also benefit from the mandatory provisions of the law of your country of residence. Consumers may bring proceedings before the court of their place of residence or any other court competent under applicable law. For professional users, the courts of Lyon have exclusive jurisdiction.

21. Language and general provisions

These Terms are available in French and in English; in case of discrepancy, the French version prevails. If any clause is held invalid, the other clauses remain in force. IntoProd’s failure to enforce a right does not waive it. These Terms, the Privacy Policy and any App-specific terms form the entire agreement between you and IntoProd regarding the Apps.
